Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TradeJournal.io platform (“Service”). By registering, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

‍2. Eligibility

- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- By creating an account, you represent that you have the legal capacity to enter into this agreement.

3. Account Registration

- To use the Service, you must create an account by providing accurate and complete information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You must notify us immediately of any unauthorized use of your account.

4. Subscription & Payment

- Access to the Service requires a paid subscription. Pricing and billing details are available on our website or via our payment providers (e.g., Stripe, Digistore24).
- Subscriptions renew automatically unless canceled prior to the next billing cycle.
- Free trials may be offered. If not canceled before the trial ends, the subscription will convert into a paid plan.
- All fees are non-refundable unless otherwise required by law.

5. Right of Withdrawal (EU Consumers Only)

If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.

- The withdrawal period will expire 14 days after the day of the conclusion of the contract.
- To exercise the right of withdrawal, you must inform us by email (support@tradejournal.io) of your decision to withdraw from this contract by means of a clear statement.
- If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed of your decision. The reimbursement will be made using the same payment method you used for the initial transaction, unless expressly agreed otherwise.

Exception for digital services:
By purchasing and using the Service during the withdrawal period, you expressly agree that the Service will begin immediately and acknowledge that you thereby lose your right of withdrawal once the Service has been fully provided.

6. Use of the Service

You agree to use the Service only for lawful purposes and in compliance with these Terms. In particular, you must not:

- Misuse the Service for fraudulent or unauthorized activities
- Attempt to disrupt, overload, or interfere with the Service
- Reverse engineer, decompile, or attempt to extract source code
- Share your account with others without authorization

7. User Content

- You may upload trading journal entries, notes, and other content (“User Content”).
- You retain ownership of your User Content. By uploading it, you grant us a non-exclusive, limited license to store, process, and display it as necessary to provide the Service.
- You are solely responsible for your User Content and must ensure it does not violate applicable laws or third-party rights.

8. Intellectual Property

- All intellectual property rights in the Service, including software, design, and branding, remain with TradeJournal.io and its licensors.
- You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Termination

- You may cancel your subscription at any time via your account settings or payment provider.
- We may suspend or terminate your account if you breach these Terms or misuse the Service.
- Upon termination, your access will end, but you may request a copy of your data before permanent deletion.

10. Disclaimers

- The Service is provided “as is” without warranties of any kind.
- We do not provide financial, trading, or investment advice. You are solely responsible for your trading decisions.
- We do not guarantee uninterrupted or error-free operation of the Service.

11. Limitation of Liability

- To the maximum extent permitted by law, TradeJournal.io shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data.
- Our total liability under these Terms is limited to the amount paid by you for the Service during the last 12 months.

12. Governing Law & Jurisdiction

- These Terms shall be governed by the laws of Austria.
- Any disputes shall be resolved before the competent courts of Leibnitz/Austria.

13. Changes to the Terms

We may update these Terms from time to time. Significant changes will be communicated via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
